What Should Be In Your Plan?

Your estate plan can and should be customized to you. But most estate plans include a combination of these documents and legal instruments:

A will: This is a list of your assets and designated beneficiaries. The more clearly your will is written, the lower the chance of problems or disputes when it comes time to distribute property.

A living trust: Also called a revocable trust, this legal instrument lets you transfer all of your assets into a trust that is controlled by you (as the original trustee). While you are acting as trustee, you'll control all assets and can decide whether or not to revoke the trust entirely. When you pass away or become incapacitated, a chosen trustee will take over for you, and the trust will become irrevocable.

An advance health care directive: In California, this document conveniently combines medical power of attorney and a living will. The person you designate as medical power of attorney will be able to make important medical care decisions on your behalf if you ever become unable to make or communicate those decisions for yourself. A living will is a list of your health care and medical treatment wishes in case of incapacity.

Durable power of attorney for finances: This will be a trusted person designated to make financial decisions on your behalf if you ever become unable to make or communicate those decisions yourself.

The tools mentioned above are common, but your estate plan can include additional tools and documents as well. The goal is to make your estate plan as clear, thorough, accurate and legally sound as possible.
